On Saturday, August 8, the Senate voted to pass the Continuing Resolution (90-6), which contained a provision to delay the provisions in Public Law 119-37, which would have put restrictions on the hemp industry starting November 12, 2026, closing the Hemp Loophole. The restrictions included in Public Law 119-37 preciously passed the Senate in a 76-24 vote. The provision in the C.R. that was voted on August 8 has further delayed these restrictions until December 11, 2026.

Senator Budd introduced an amendment (Amendment 6747) trying to strike this provision that delayed the implementation of Public Law 119-37. CADCA coordinated a letter signed by 56 national/state public health, public safety, consumer protection, and community groups signed onto a letter urging Senate leadership and members to allow for a vote on Budd’s amendment and to support the amendment. The letter can be viewed here. While a vote was held on Senator Budd’s amendment, the amendment was not passed in a 61-32 vote. The Continuing Resolution passed by the Senate will now go back to the House for them to vote on the changes made by the Senate.
